Welcome to Domain28. These Terms of Service ("Terms") govern your use of domain28.netand any software development, design, maintenance retainer, or Web Ops consultancy services provided by Domain28 ("Services").
1. Scope of Services
Domain28 delivers custom Next.js/Tailwind web applications, ongoing site management, and tech stack implementation. Deliverables, timelines, and payment terms are detailed in individual statements of work (SOW) or project proposals.
2. Billing & Retainers
- Custom Projects: Invoiced according to milestones in individual project proposals.
- Recurring Retainers: Monthly support and maintenance retainers are billed in advance on an automated schedule.
- Late Payments: Unpaid invoices may lead to temporary suspension of active development, support, or hosted services.
3. Intellectual Property
Upon complete payment of project invoices, clients receive full ownership of custom design assets, site copy, and custom code generated specifically for their deployment. Domain28 retains ownership of pre-existing core libraries, scaffolding code, and reusable developer utilities.
4. Hosting & Infrastructure
Our applications connect with external infrastructure platforms (including Cloudflare, Vercel, Google Workspace, and GitHub). Domain28 is not liable for external downtime, service interruptions, or third-party platform policy modifications beyond our direct control.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Domain28 shall not be liable for indirect, incidental, or consequential damages arising from service usage. Aggregate liability will not exceed the amounts paid to Domain28 in the three (3) months preceding any claim.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tennessee.
